The driver of the truck that hit me had no insurance. What are my options?
There are a number of options depending upon what factual scenarios actually exist. The first thing that we would do is to try to find out the owner of the truck if it’s different than the driver. Perhaps it is a a company or an entity that has their own insurance and the driver’s their permissive user. In those situations, the driver may actually be covered by that policy of insurance. If it turns out that there is no insurance available either as to the driver or the owner of the truck or the employer of the driver, then there are other things that need to be looked at, which would include number one, does that person have assets or the financial resources to respond in damages? And as in any other type of case where a truck driver or an automobile driver does not have any insurance, do you, the injured party, have your own uninsured motorist type of coverage? Those are questions that need clearly to be addressed by someone that specializes in this type of practice.
